By accessing or using the services provided by DealerCarLeads, a service of Pascual Technologies LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
DealerCarLeads provides automotive marketing services to licensed car dealerships, including but not limited to:
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
Our services are available only to licensed automotive dealerships and businesses operating in the United States. By using our services, you represent that you hold all required licenses and permits to operate as an automotive dealer.
Monthly subscription fees are due at the beginning of each billing cycle. All fees are non-refundable unless otherwise stated in writing. Failure to pay may result in suspension or termination of services.
We reserve the right to adjust pricing with 30 days' written notice.
Either party may cancel services with 30 days' written notice. There are no long-term contracts. Upon cancellation, access to services will continue through the end of the current billing period.
All video content, graphics, and marketing materials produced by DealerCarLeads on your behalf are licensed to you for use in your marketing. We retain the right to use produced content as portfolio examples unless you request otherwise in writing.
You are responsible for ensuring that any materials, logos, or information you provide to us do not infringe on third-party intellectual property rights.
By providing your phone number and opting in, you consent to receive SMS/text message communications from DealerCarLeads. You may opt out at any time by replying STOP. Message and data rates may apply. We are not responsible for delays or failures in SMS delivery.
Participation in the DealerCarLeads broker network is subject to separate referral fee agreements. Referral fees are only owed when a vehicle sale is directly attributable to a broker referral. All referral disputes must be submitted in writing within 14 days of the sale date.
To the fullest extent permitted by law, DealerCarLeads and Pascual Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, or loss of business opportunity, arising out of or in connection with your use of our services.
Our total liability in any matter arising out of these Terms shall not exceed the total fees paid by you in the three (3) months preceding the claim.
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee any specific results, number of leads, or sales from use of our services.
You agree to indemnify, defend, and hold harmless DealerCarLeads and Pascual Technologies LLC from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Palm Beach County, Florida.
We reserve the right to update these Terms at any time. Continued use of our services after any changes constitutes acceptance of the new Terms. We will provide notice of material changes via email or on our website.
